PREAMBLE
This document sets forth the terms and conditions (hereinafter, the “Terms”) governing access to and use of the website https://us.perrosygatoscolombia.com (hereinafter, the “Website”), owned by Perros y Gatos Colombia (hereinafter, “the Company”), as well as the process for viewing and purchasing the pets offered on the Site.
We recommend that you read this document carefully before using the Website.
1. Acceptance of the Terms
Accessing, browsing, or using the Website confers the status of User and implies full and unreserved acceptance of each and every one of the Terms set forth herein. If the User does not agree to these Terms, they must refrain from using the Website. The purchase of a pet will also imply acceptance of the purchase terms detailed herein.
2. Purpose of the Website
The purpose of the Website is to showcase dogs and cats bred by the Company, provide information about them, and offer a contact channel for interested and qualified users to initiate the adoption process.
3. User Obligations
The User agrees to: a) Use the Website in a diligent, proper, and lawful manner. b) Provide truthful, accurate, and complete information in contact or request forms. c) Be of legal age and have full legal capacity to enter into contracts and be bound by the terms of this document. d) Refrain from performing acts that may damage, disable, overload, or impair the Website or prevent its normal use by other Users.
4. Pet Adoption Process
The process for adopting a pet is governed by the following steps and conditions:
4.1. Application and Reservation The posting of a pet on the Website constitutes an invitation to make an offer. The submission of an application form by the User does not constitute a reservation nor does it guarantee the sale of the pet. The Company reserves the right of admission and may reject any application if it considers that the applicant does not meet the necessary requirements to ensure the animal’s well-being. A reservation will be finalized only after the application is approved and a deposit is paid, the terms of which will be communicated directly to the buyer. This reservation deposit is non-refundable in the event of withdrawal by the buyer.
4.2. Prices and Payments Pet prices are listed in Colombian pesos (COP) and do not include shipping costs or additional accessories, unless otherwise specified. The total price and accepted payment methods will be communicated to the buyer during the checkout process. Full payment of the agreed-upon amount must be made prior to the pet’s delivery.
4.3. Health Guarantee The Company guarantees that all pets are delivered in optimal health, with their vaccination and deworming schedules up to date, and free of any latent viral diseases at the time of delivery.
- Veterinary Examination: The Buyer agrees to take the pet to a licensed veterinarian within 72 business hours of delivery for a general examination. Failure to comply with this clause will void the health guarantee.
- Warranty for Congenital Diseases: A one (1) year warranty is offered against serious genetic or congenital diseases that compromise the pet’s quality of life. To activate this warranty, a written diagnosis from two licensed veterinarians is required, one of whom must be a specialist in the relevant field. If confirmed, the Company agrees to replace the pet with one of similar characteristics from the next available litter. Under no circumstances will the warranty cover veterinary expenses, treatments, or cash reimbursements.
4.4. Delivery and Liability The costs and risks associated with transporting the pet from the Company’s facilities to the Buyer’s residence shall be borne entirely by the Buyer. The Company may assist in coordinating with specialized transporters but shall not be liable for any incidents occurring during transit.
4.5. No Refund Policy Given the nature of the transaction (sale of living beings), no returns are accepted and no cash refunds are issued once the pet has been delivered to the Buyer, except in cases covered by the Health Guarantee stipulated in clause 4.3.
5. Intellectual Property
All content on the Website, including, but not limited to, text, photographs, logos, graphics, and images, is the exclusive property of the Company or of third parties who have authorized its use, and is protected by Colombian intellectual property laws. Reproduction, distribution, or modification of such content is strictly prohibited without the Company’s express written authorization.
6. Clause de non-responsabilité
L’ensemble du contenu du site Web, y compris, sans s’y limiter, les textes, photographies, logos, graphiques et images, est la propriété exclusive de la Société ou de tiers ayant autorisé son utilisation, et est protégé par la législation colombienne en matière de propriété intellectuelle. La reproduction, la diffusion ou la modification de ce contenu est strictement interdite sans l’autorisation écrite expresse de la Société.
7. Modification des conditions générales
La Société se réserve le droit de modifier unilatéralement et à tout moment les présentes conditions générales. Les modifications entreront en vigueur dès leur publication sur le site web.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any controversy, dispute, or claim arising out of this agreement shall be submitted to the jurisdiction of the competent courts of the city of Medellín, Colombia, and the parties hereby waive any other venue to which they might be entitled.
